Personal Information

• Non-Account Activity. You can view certain content provided by users to the TenM3 Website (collectively, “User Feeds”) on the TenM3 Website without having an account with TenM3 (a “TenM3 Account”).  You can also contact us about a particular User Feed without having a TenM3 Account.
  
  
• Account-Related Activity. Certain other activities on the TenM3 Website — like sending a User Feeds, posting comments, flagging User Feeds, or sharing User Feeds—require you to have a TenM3 Account.  We ask for some personal information when you create a TenM3 Account, including your email address and a password, which is used to protect your account from unauthorized access.  A TenM3 Account allows you to access many of our services that require registration.
  
  
• Usage Information. We may record information about your usage, such as when you use TenM3, the User Feeds you subscribe to, the contacts you communicate with, the videos you watch, and the frequency and size of data transfers, as well as information you display or click on in the TenM3 Website (including UI elements, settings, and other information).  If you are logged in, we may associate that information with your account.  We may use clear GIFs (a.k.a. "Web Beacons") in HTML-based emails sent to our users to track which emails are opened by recipients.
  
  
• The TenM3 Website is not intended for children.  We do not intend or desire to collect personal information from anyone we know to be under thirteen (13) years of age.
  
  
• Content Uploaded to Site. Any personal information or video content that you voluntarily share publicly or with a group online (on the website, in the forums, within your profile pages, etc.) becomes available to others and can be collected and used by others.

Uses

• If you submit personally identifiable information to us through the TenM3 Website, we use your personal information to operate, maintain, and provide to you the general and personalized features and functionality of the TenM3 Website, and to process any flagging activity or correspondence you send to us.
  
  
• Your account name (not your email address) and location that you provided is displayed to other users when you send User Feeds through the TenM3 Website.  Any User Feeds that you submit to the TenM3 Website will be shared with the group that you designate and may be further shared (by the members of this group) with others. If the User Feeds are made Public, they will be available to anyone on the Internet.
  
  
• We do not use your email address or other personally identifiable information to send commercial or marketing messages without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out.  We may, however, use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major TenM3 Site changes or for customer service purposes).
  
  
• While sending User Feeds to the TenM3 Website, we use your Internet protocol (“IP”) address and/or phone number to get the User Feeds.  We track the number of bytes transferred and stored that are associated with User Feeds. This information is also entered into logs (and made available to you) to help manage the account. This information may also be used in an aggregate form to improve the quality and user experience on the site. It is not used for any other purpose.
  
  
• TenM3 Website may be accessed over the Internet or by phone.  As a service feature, we may contact you via email or a SMS message.
  
  
• The User Feeds you designate as “Private” are only available to you and to the group designated by you within the timeframe that you specify.  While reasonable measures are taken to limit distribution of these Private feeds, as is the nature of the Internet, there is no guarantee that others could not get access to these User Feeds. 
  
  
• We use both your personally identifiable information and certain non-personally-identifiable information (such as anonymous user usage data, cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of the TenM3 Website and to create new features, promotions, functionality, and services by storing, tracking, analyzing, and processing user preferences and trends, as well as user activity and communications.
  
  
• We use cookies, clear gifs, and log file information to: (a) store information so that you will not have to re-enter it during your visit or the next time you visit the TenM3 Website; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; and (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.  If your browser is set to reject cookies, or if your browser notifies you that you are about to receive a cookie and you reject it, then your use of the Site may not be as efficient or as enjoyable as it would be if the cookie were enabled.
  
  
• We use third party payment processors such as Paypal and others to allow you to pay for use of the TenM3 Website.  All payment processing is performed by such third parties.  We do not store any payment specific information such as account numbers, credit card numbers, your billing address etc on our servers.  We only store amounts paid associated with your user account.
  
  
• We may disclose your information to our third party contractors who perform services for us in order to provide services through the Site or to complete or confirm a transaction you conduct through the TenM3 Website.  These contractors are permitted to use the personal data only for the purposes of such services or transaction.
  
  
• We may disclose the information obtained from you through this TenM3 Website as part of a merger, acquisition or other sale or transfer of our assets or business.

Your Choices

• You may, of course, decline to submit personally identifiable information through the TenM3 Website, in which case you can still view User Feeds and explore the TenM3 Website, but TenM3 may not be able to provide certain services to you.
  
  
• You may update or correct your personal profile information and email preferences at any time by visiting your account profile page.

Third-party Advertisers, Links to Other Sites

TenM3 does not provide any personally identifiable information to advertisers without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out.  The advertiser may also use information regarding your use of the TenM3 Website; such as the number of times you viewed an ad (but not any personally identifiable information), to determine which ads to deliver to you.

You should consult the respective privacy policies of these third-party advertisers for more information on their practices and for instructions on how to opt-out of certain practices. TenM3 privacy policy does not apply to, and we cannot control the activities of, such other advertisers or web sites.

Updates

We reserve the right to update this Privacy Policy from time to time.  Please visit this page periodically so that you will be apprised of any changes.  However, we will only use personal information in accordance with the Privacy Policy that was in effect at the time the information was collected.  If at any point we should decide to use personal information differently that had previously been collected, we will notify users through a posting on the TenM3 Website or by email.
